Membership Terms & Conditions

AGREEMENT
  • An Agreement is made with TOA once an application for membership has been approved and payment of membership fees or part payment of membership fees has been made to TOA. This Agreement is governed by the laws of Australia.
  • Members must sign the back of the TOA membership card immediately upon receipt so as to activate membership. TOA membership is deemed inactive until the TOA membership card is signed by the TOA member.
  • It is important that the terms of the Agreement with TOA are clear and for this reason, if there is any conflict between what is set out in these Terms and Conditions and anything you have been told by TOA representatives, these terms and conditions of membership will prevail. Failure by TOA to enforce any of its rights at any time for any period shall not be construed as a waiver of those rights.
MEMBERSHIP ENTITLEMENT
Membership of TOA entitles members to the TOA member benefits in accordance with the membership terms and conditions and the respective rules of the participating golf courses. Membership of TOA is non-assignable, non-transferable and non-refundable except as permitted by the Membership Terms and Conditions.
CHANGE OF DETAILS
Members must keep TOA informed of any change of address, email address, contact phone numbers, bank account & credit card details for payment and any other personal or business information TOA considers relevant to the membership. In TOA’s communications with Members, TOA shall not be obliged to do any more than to rely upon its most current record of a Member’s contact details.
TOA MEMBERSHIP
  • TOA reserves the right to refuse any application for membership at its sole discretion without providing reasons for its decision.
  • Membership fees must be fully paid before TOA membership rights can be activated.
  • TOA membership starts on the day you activate your membership by entering your membership code contained on your TOA membership card or 3 business days after TOA has mailed the membership card, whichever is the earlier.
  • The benefits or entitlements of membership cannot be redeemed for cash. TOA membership is not an investment. TOA membership is a leisure based concept designed to enable members to play golf with access to more than one golf course.
  • Members must be able to demonstrate that they are employed for not less than 30 hours a week, or are a member of an Australian golf club or are self-employed. Members must be at least eighteen (18) years of age.
  • TOA membership is strictly for a 12 month period. Rounds not used by the expiry date will be forfeited.
  • TOA membership, TOA members must enter the membership code identified on the card either online www.teeoffaus.com.au or by calling 1300 TEE OFF.
  • Tee Off members must sign the back of the Tee Off membership card to activate membership. Any membership card not signed by the member is deemed to be invalid and member benefits will be denied.
  • In the event that a membership card is stolen or lost the member must report this to TOA immediately. Any rounds used by non-members using a lost or stolen card must be paid for by the member holder of the lost or stolen membership card.
  • If it is found that the membership card has been used fraudulently as a result of the card being misused by a member or non-member, the member will be liable for the rounds played and will be required to compensate TOA for the rounds played.
  • Personal information held by TOA in relation to a member is confidential.
  • Members are entitled to promotional specials applicable to their membership. TOA will use its reasonable endeavours to deliver the membership card to the members mailing address or home address within 14 days from the date of joining TOA and payment of the membership fee. TOA accepts no liability or responsibility for misplaced, lost or delays in delivery of membership cards beyond TOA’s direct control.
CORPORATE MEMBERSHIP
  • TOA terms and conditions apply to all corporate memberships
  • TOA individual memberships that make up the corporate membership can be transferred to other directors, employees and/or consultants within the registered corporate member company in certain circumstances. The rights attributed to the individual membership are fully transferable. A representative of the corporate member company is required to notify TOA in writing identifying the reason why the individual membership is to be transferred to another holder. Acceptable reasons include; medical reasons, termination or resignation of employment. TOA may refuse the transfer of membership at its full discretion
  • Individual TOA members of Silver, Gold and Platinum TOA corporate membership packages must be either a director, employee or consultant of the TOA corporate member company
MEMBERSHIP FEES
  • TOA membership fees are as advertised. Any change in TOA’s membership fees does not entitle any member to renegotiate membership fees at the advertised rate periodically promoted.
  • TOA may have a number of other categories of membership available from time to time. Information about membership categories and terms and conditions attaching to other membership categories can be found at www.teeoffaus.com.au .
  • TOA may offer promotional/special rates to members from time to time. Details of promotional/special rates must be quoted as advertised in order for a member to receive the advertised rate.
ADMINISTRATION FEE
There is a non refundable administration fee payable if the member chooses to cancel TOA membership during the Cooling Off period. This fee is charged at the absolute discretion of TOA.
MEMBERSHIP RENEWAL
  • A written advice will be sent out to you 30 days prior to expiry of your membership specifying the amount payable to renew your membership.
Direct Debit Cancellations
RENEWALS
TOA will notify you by mail at least 30 days before your membership renewal due date, that we will process your renewal automatically by Direct Debit on the date of your renewal due date. You must advise us of any changes to your membership, including change of bank or credit card details, or cancellations before the commencement of your renewal month.
CHANGE IN GST RATE
All membership fees payable are "GST inclusive". If the rate at which GST is charged changes then the membership fees payable will increase or decrease by the amount by which GST increases, or decreases. Any increase or decrease in GST will apply to members’ fees payable only when membership’s fees are first charged or at the time of membership renewal.

  • Persons opting to take advantage of the interest free payment plan can pay by instalments via credit card, Direct Debit Request (DDR) or by self managed direct debit instalments. TOA membership fees must be paid in full before membership can be activated.
  • Applicants paying under the interest free payment plan may withdraw their application prior to making the final payment. A cancellation fee may apply in addition to a non refundable administration fee.
  • Strictly no refunds will apply after 7 days following payment of annual membership fees in full.
  • A copy of TOA member credit card details, bank details or Direct Debit Request (DDR) is required to be retained by TOA. In the event that a member raises a charge or fee payable by TOA, TOA will generate a transaction debiting the member’s credit card or bank account for the charge or fee incurred.
DIRECT DEBIT AGREEMENT
TOA’s commitment to members
This document outlines TOA service commitment to members, in respect of the Direct Debit Request (DDR) arrangements made between TOA and members. It sets out member’s rights, TOA’s commitment to members and member responsibilities to TOA, together and where members should go for assistance.
Initial terms of the DDR arrangement
Under the Direct Debit Request (DDR) arrangements made between TOA and members, TOA undertakes to periodically debit the member’s nominated account for the agreed amount of the monthly membership fees due and payable under the interest fee payment plan if this option has been selected in the Membership Application.
Payment arrangements
Monthly payments under the Direct Debit arrangement will occur on the day of the agreement or on the 1st of the month commencing on the date of the agreement. If a payment falls due on a non-business day, it will be payable on the next business day. Please note that payments may take up to 5 business days to be debited on the members’ account. TOA will provide the member with at least 30 days notice if changes to the initial terms of the arrangement are made. If members wish to discuss any changes to the initial terms, please contact a TOA account manager on 1300 TEE OFF. If the members’ direct debit is returned or dishonoured by TOA’s financial institution, we will endeavour to contact the member for payment. If TOA does not receive payment, TOA will debit the members’ account again along with and including any outstanding membership payments due on or before the next Direct Debit cycle. Transaction and administration fees will be charged to the member’s account in the case of any failure to satisfactorily direct debit against the member’s account.
MEMBER’S RIGHTS
Changes to the arrangement
If members want to vary or stop the direct debit arrangements, written notice of this must be forwarded to TOA and the member’s financial institution, including details of all changes requested to the payment authority.
Enquiries and Disputes
Should members wish to discuss direct debit arrangements, including disputed amounts, they must call TOA on 1300 TEE OFF or the members’ financial institution directly. Where disputes are referred to TOA, TOA will endeavour to respond to them within 7 days. If the member does not receive a satisfactory response from TOA in relation to the dispute, the member may contact the member’s financial institution who will respond to the claim in accordance with their published policy and dispute handling processes.
BOOKING GOLF ROUNDS
  • All golf round bookings must be made directly to the TOA accredited golf course. After making the booking, TOA members must contact TOA at www.teeoffaus.com.au or 1300 TEE OFF to advise the member and guest booking details. TOA will provide the member with a voucher number for the booking. The voucher number can be provided over the phone, member website login, emailed and/or sent via SMS to the member.
  • Members will be required to confirm their identity with a TOA account manager over the phone by verifying personal and account information on request [for instance mother’s maiden name (given on application) and last played round (where), or other verification information TOA deems necessary].
  • Accredited TOA golf courses can only be played a maximum of 5 times by a member in any one 12 month membership period.
  • TOA members are entitled to the member 6+ rate once they have played the maximum of 5 rounds per course.
  • TOA members can only play 1 round of golf per day. A round of golf is either 9 holes or 18 holes played consecutively.
  • All golf tee off bookings must be made not less than 48 hours in advance, but not more than [30] days in advance.
  • Guest rounds must be booked in advance by a TOA member to obtain discount guest rates, subject to availability at the selected course. Guest discount rates are only available for bookings where the TOA member making the booking will be playing in the same playing group as the member’s guests.
  • TOA members must produce to the golf course current Photo ID and their membership card before play begins.
  • Tee Off members must provide the booking voucher number to the golf course prior to play.
  • Tee times and course selection are subject to availability.
  • TOA has the right to cancel golf bookings, without notice and without compensation.
  • All TOA members and their guests must register with the course Golf Shop prior to play.
  • TOA’s arrangement with certain golf courses requires compulsory use of a cart for the round of golf. On these compulsory cart courses a standard $25 per person fee will apply.
GOLF ROUND CANCELLATIONS
  • All member cancellations of golf rounds must be made to the golf course and to TOA (www.teeoffaus.com.au or 1300 TEE OFF)
  • All cancellations of golf rounds must be made not less than 24 hours prior to play. Cancellation fees may apply.
COOLING OFF PERIOD
TOA members have a Cooling Off period of 7 days commencing on the date of either full payment of membership fees or the first payment under a payment plan. If members wish to utilise this period to cancel their membership during the Cooling Off Period, they are required to tell TOA in writing (preferably on the form supplied by TOA). TOA will cancel the TOA membership and refund the initial payment less an administration fee. After the Cooling Off Period ends, if the member wishes to cancel their membership or the agreement, they must pay certain fees to TOA. Please refer to the following cancellation provisions for full details in relation to member rights to cancel membership and the fees payable in those circumstances.
TOA MEMBERSHIP CANCELLATIONS
  • TOA membership cancellation requests must be made in writing to TOA.
  • Once fully paid, TOA membership cannot be cancelled or refunded.
  • In the event a TOA customer wants to cancel their instalment plan with TOA there will be a $150 AUSD cancellation fee charged to the customer. This amount will be deducted from the amount the customer has paid TOA for TOA membership and the remainder will be paid to the customer as agreed to with TOA. Where the customer’s TOA membership instalment payments are less than $150 AUSD, this amount will be deemed the cancellation fee and retained by TOA.
CLUB ETIQUETTE
  • Members must comply with the Golf Club/Courses local Rules, dress standards and behaviour conduct required. Members must ensure they read, understand and abide by the Rules of the Club before commencing play.

MISCONDUCT
  • Any misconduct or misbehaviour of a TOA member or persistent breach of Club and Golf etiquette by a member shall be deemed to be a serious breach of the terms and conditions of TOA membership: A Member shall behave in a considerate manner towards other members, players and Gold Club Staff. A member shall exercise restraint in his/her use of language. A member shall honour the rules of golf and golf etiquette at all times. Any member not abiding by the terms and conditions of TOA Membership may have their membership suspended or cancelled.
  • TOA Standards provide a basic outline of the etiquette of golf expected of all players including guests of TOA members.
  • TOA members shall be at all times responsible for the conduct of their guests.
  • TOA may in its sole discretion cancel, suspend or restrict membership status in the event of misuse/abuse of membership or in the event of a breach of any of these terms and conditions.
ACTION FOR MISCONDUCT
Any member found by the Board or Manager of TOA to be, on the balance of probabilities, in breach of the conduct and behaviour standards set out in the previous clause can be made subject to the disciplinary sanctions of membership cancellation, suspension or imposition of restricted membership status without the need for a hearing provided that the member accused of any breach of the conduct and behaviour standards shall be given the opportunity of providing a written submission to TOA (in response to allegations made) within a time frame set by TOA.
PERMISSION/PRIVACY
Members consent to TOA (and associated companies) contacting them by telephone, direct mail or e-mail to keep members informed of promotional and/or new developments or offers regarding their membership. TOA complies with the Australian National Privacy principles and regulation. Members can request a copy of TOA’s privacy policy by contacting 1300 TEE OFF.
COMPETITIONS
  • All members will be eligible to play coordinated competitions under the rules & conditions set by TOA. Dates for coordinated competitions will be available on the TOA website. All competition bookings are subject to availability.
  • Member’s participating in TOA golf competitions and events will incur entry fees determined by TOA from time to time.
MISCELLANEOUS
  • TOA reserves the right to alter, vary or amend the terms and conditions of membership and shall notify members of any such alteration, variation or amendment in such manner as TOA deems appropriate and reasonable having regard to all relevant considerations.
  • These terms and conditions shall be governed by and construed in accordance with the laws of Australia, and the member hereby submits to the non exclusive jurisdiction of the Australian courts to settle any disputes in relation to the matters set out herein.
  • If any of the provisions of these terms and conditions is found by a court or other competent authority to be void or unenforceable, such provision shall be deemed to be deleted from the terms and conditions and the remaining provisions of the terms and conditions shall continue in full force and effect.
Victoria and Northern Territory warning only - WARNING UNDER THE FAIR TRADING ACT 1999 (VIC) AND CONSUMER AFFAIRS AND FAIR TRADING ACT (NORTHERN TERRITORY) - Under the provisions of the Fair Trading Act 1999 (Vic) and Consumer Affairs and Fair Trading Act (Northern Territory), several conditions are implied into contracts for the supply of certain goods and services. These conditions mean that the supplier named on this form is required to ensure that the recreational services it supplies to you are - rendered with due care and skill; and as fit for the purpose for which they are commonly bought as it is reasonable to expect in the circumstances; and reasonably fit for any particular purpose or might reasonably be expected to achieve any result you have made known to the supplier. Under section 32N of the Fair Trading Act 1999 (Vic) and section 68A of the Consumer Affairs and Fair Trading Act (Northern Territory), the supplier is entitled to ask you to agree that these conditions do not apply to you. If you sign the Contract, you will be agreeing that your rights to sue the supplier under the Fair Trading Act 1999 (Vic) and Consumer Affairs and Fair Trading Act (Northern Territory) if you are killed or injured because the services were not rendered with due care and skill or they were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Membership Terms & Conditions. NOTE: The change to your rights under the Fair Trading Act 1999 (Vic) , as set out in these Membership Terms & Conditions, does not apply if your death or injury is due to gross negligence on the supplier's part (however, there is no corresponding provison under the Consumer Affairs and Fair Trading Act (Northern Territory). "Gross negligence" is defined in the Fair Trading (Recreational Services) Regulations 2004 (Vic).
ACCEPTANCE OF RISK
  • TOA members acknowledge and accept that playing golf can be a hazardous activity and that there is a real risk of physical injury which could result in death or injury and agree to not hold TOA liable for any physical injury or death resulting from membership of TOA.
  • Every applicant for TOA membership hereby agrees to abide by the above terms and conditions of membership.
  • Every member and their guests uses a golf club or course at their own risk without any acceptance by TOA for the consequences and without acceptance of liability by TOA for any property damage occasioned by a member or their guest, including lost or stolen property.

Golf Etiquette
  • Etiquette is the term given to courtesies extended to and from other golfers.
  • Before playing a stroke always make sure that no player is in your line of play or in the path of your swing.
  • Don't move, talk, or create a disturbance while another player is preparing for or hitting a shot.
  • Never stand behind the hole or another persons’ ball.
  • Don't play a shot until the players ahead are out of range.
  • Leave the putting green immediately you have finished the hole and mark your score card on the next tee.
  • Always walk quickly between shots and be ready to play when it is your turn.
  • If sand buckets are provided, carry one with you and be sure to fill any divot holes with sand. If sand buckets are not provided replace any divots (displaced turf) and pat down with your foot.
  • Always rake the bunkers smooth before you leave.
  • Always repair any pitch marks on the green with a pitch mark repair tool or a golf tee.
  • Never walk your buggies or drive carts over the putting green or the teeing ground.
  • Take care when replacing the flag stick as greens are easily damaged.
  • Minors shall not be permitted on a golf course unless permitted by the relevant golf club/course and, only then under adult supervision.
  • The Playing Rules of The Royal and Ancient code of Golf as adopted by participating clubs/courses must be observed at all times.
